Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy supplements the LivingLean Privacy Policy and applies in circumstances where information Poshfit AI, Inc. d/b/a LivingLean ("LivingLean," "we," "us," or "our") processes may be considered "Consumer Health Data" subject to the Washington My Health My Data Act (Wash. Rev. Code ch. 19.373), Nevada SB 370, or other applicable U.S. state consumer health privacy laws. When we say "Consumer Health Data," we mean personal information that is linked or reasonably could be linked to you and that identifies your past, present, or future physical or mental health status, as defined by those laws.
1. Scope
LivingLean is a direct-to-consumer wellness and accountability coaching service. It is not a medical, healthcare, diagnosis, or treatment service. This policy describes our practices with respect to wellness information that may be considered consumer health data under applicable state laws.
2. Categories of Consumer Health Data We Collect
Given the breadth of the state consumer health data privacy laws referenced above, some of the wellness information we collect may be considered to be Consumer Health Data. The categories may include:
Wellness goals, dietary preferences, and lifestyle information
Weight, body measurements, and progress information
Meal descriptions, nutrition tracking, and eating patterns
Exercise, movement, sleep, and hydration information
Cravings, temptation reports, and accountability conversations
Food allergies and dietary restrictions you choose to share
General wellness context you choose to provide to your AI coach, which may include information you consider health-related
Coaching conversation content and AI-generated coaching responses
Inferences derived from the above
3. Sources of Consumer Health Data
We collect consumer health data:
Directly from you when you create an account, complete your wellness profile, and interact with the AI coach
Generated by the AI coach based on your inputs (e.g., coaching responses and personalization notes)
Derived from your interactions with the Services
4. How We Use Consumer Health Data
We use consumer health data for the following purposes:
To provide and personalize the wellness coaching Services
To remember your goals, preferences, and coaching context for continuity
To generate AI-powered coaching responses tailored to what you have shared
To operate in-product safety features, including displaying crisis resources when appropriate
To provide customer support
To comply with legal obligations
To create de-identified or aggregated information, which is no longer consumer health data
5. Categories of Third Parties and Affiliates With Whom We Share Consumer Health Data
We share consumer health data only with the following categories of recipients, and only for the purposes described in Section 4:
AI Model Providers: Anthropic (used to power the AI coach), pursuant to contractual restrictions that prohibit use of your data to train general-purpose AI models
Cloud Hosting and Infrastructure Providers: Amazon Web Services
Security and Monitoring Providers
Professional Advisers (legal, accounting) as needed for legal compliance
Law enforcement or government authorities when required by law
Affiliates
The following affiliates may receive consumer health data: None
6. We Do Not Sell Consumer Health Data
We do not sell consumer health data, exchange it for value, or share it for targeted advertising or cross-context behavioral advertising.
7. Consent
We collect consumer health data only after obtaining your affirmative, opt-in consent, except where collection is strictly necessary to provide a product or service you have specifically requested. Consent to collection is obtained separately from any consent to share consumer health data with third parties. You may withdraw your consent at any time by contacting us using the information in Section 10, or by deleting your account.
Withdrawal of consent may limit or prevent your ability to use certain features of the Services. Withdrawal does not affect the lawfulness of any collection, use, or sharing that occurred before withdrawal.
8. Your Rights
Subject to applicable law, you have the following rights with respect to your consumer health data:
Right to confirm whether we are collecting, sharing, or selling your consumer health data
Right to access your consumer health data, including a list of all third parties and affiliates with whom we have shared your consumer health data
Right to withdraw your consent to the collection or sharing of your consumer health data
Right to have your consumer health data deleted
Right to appeal a denial of a request
9. How to Exercise Your Rights
To exercise any of the rights described above, contact us at privacy@livinglean.ai. We will respond within the timeframes required by applicable law. We will verify your identity before processing a request. If we deny your request, we will provide instructions for submitting an appeal in our response.
We will not discriminate against you for exercising these rights. If we deny an appeal, you may contact the Washington Attorney General's Office (for Washington residents) or the Nevada Attorney General's Office (for Nevada residents).
